Please read these Terms & Conditions carefully before using our service. By requesting a quote and sending your cards to us, you agree to be bound by these terms.

1. About Us & These Terms

These Terms & Conditions ("Terms") govern the sale of trading cards by you ("you", "the seller") to Swapmycards ("we", "us", "our"). Swapmycards operates a buyback service through which we purchase Pokémon and other trading cards from members of the public.

These Terms apply to every quote, order and transaction between you and us. By submitting an order through our website, you confirm that you have read, understood and agree to these Terms.

Swapmycards is a trading name of Swapmycards Ltd. Our registered contact details are set out in section 16.

2. Definitions

3. Quotes & Pricing

Quotes provided on our website are indicative offers based on the condition you select and are not a final, binding valuation. The final buyback price is confirmed only after we have received and assessed your cards.

Quoted prices may change at any time to reflect market conditions. The price applicable to your order is the price displayed at the time you submit that order, provided your cards are received by us within the timeframe set out in section 5 and match the condition stated.

All prices are in pounds sterling (GBP) and are the total amount payable to you, with no deductions for administration or assessment.

4. Card Condition Grading

When creating an order, you must select the condition grade that most accurately reflects each card. Our condition guide sets out what each grade means. You are responsible for grading your cards honestly and accurately.

If you are unsure of a card's grade, we recommend selecting the lower of the two possible grades. If, on assessment, a card is found to be in better condition than stated, we will pay you the higher applicable price. If it is in worse condition, section 7 applies.

Our assessment of condition is carried out by our team and is final, subject to your rights under section 7.

5. Sending Your Cards

Once you submit an order, you are responsible for sending your cards to us at the address provided at checkout. You should send your cards within five (5) days of submitting your order. Orders received after this period may be re-quoted at then-current prices.

We recommend using a tracked postal service (such as Royal Mail Tracked 24). You are responsible for the cost of postage and for the safe packaging of your cards. We strongly recommend using card sleeves, top-loaders and a padded envelope.

Cards remain your responsibility and at your risk until they are received by us. We are not liable for cards that are lost, delayed or damaged in transit. We recommend retaining your proof of postage and using an appropriate level of postal insurance for valuable cards.

6. Our Assessment

Once your cards are received, we will assess each card to confirm its authenticity and condition grade. We aim to complete assessment within a reasonable period, typically within one business day of receipt, though this is not guaranteed.

Our assessment includes checking each card against the condition grade you selected and confirming it is a genuine card. We reserve the right to decline to purchase any card at our discretion, including cards we cannot authenticate (see section 11).

7. Revised Offers

If, on assessment, a card's condition differs from the grade you selected such that a different price applies, we will contact you using the details you provided with a revised offer before making any payment.

You may choose to:

If we do not receive a response to a revised offer within a reasonable period (which we will state when contacting you), we may hold the cards pending your instruction. We will not proceed to purchase at a revised price without your agreement.

8. Payment

Once your buyback price is confirmed (and any revised offer accepted), we will pay you using the payment method and details you provided — bank transfer or PayPal. We aim to make payment within 48 hours of confirming your card grades.

It is your responsibility to provide accurate payment details. We are not responsible for payments delayed or misdirected as a result of incorrect details supplied by you.

Payment timescales for funds to appear in your account may vary depending on your bank or payment provider.

9. Ownership & Title

By sending cards to us, you confirm that you are the legal owner of those cards, or are authorised to sell them, and that they are free from any third-party rights, charges or encumbrances.

Ownership of and title to the cards passes to us upon payment being made to you. Once payment has been made, the sale is final and cards cannot be returned to you.

10. Eligibility

To use our service, you must be at least 18 years of age and resident in the United Kingdom, unless otherwise agreed by us in writing. By submitting an order you confirm that you meet these requirements.

11. Authenticity & Counterfeit Cards

You confirm that all cards you send to us are genuine. We do not purchase counterfeit, fake, or unofficial reproduction cards.

If we identify a card we reasonably believe to be counterfeit, we will not purchase it. We may return such cards to you, retain them, or take other action as required by law. Knowingly sending counterfeit cards may constitute a criminal offence.

12. Liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited or excluded by law.

Subject to the above, our total liability to you in connection with any order shall not exceed the buyback price payable for the cards in that order. We are not liable for cards lost or damaged in transit to us (see section 5).

13. Data & Privacy

We collect and process personal information you provide (such as your name, contact details and payment information) in order to process your order and make payment. We handle your data in accordance with applicable data protection law, including the UK GDPR.

We will not sell your personal data. For more information about how we handle your data, please contact us using the details in section 16.

14. Changes to These Terms

We may update these Terms from time to time. The version that applies to your order is the version published on our website at the time you submit that order. We recommend reviewing these Terms each time you use our service.

15. Governing Law

These Terms and any dispute arising out of them are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. Nothing in these Terms affects your statutory rights as a consumer.
